Twenty-one year-old University student Gal Presser was arrested and charged with trespassing after verbal warning and resisting an officer without violence.
He was also charged with battery on persons 65 years of age or older, which can range “from a misdemeanor of the first degree to a felony of the third degree,” as stated in the Florida Statutes.
According to the police report, Officer Frank Torres responded to a call which mentioned that there was a possible fight at Gate 5. After arriving at the location, Torres told Presser to leave the stadium. “I’m not going anywhere,” Presser responded. As a result, Torres “attempted a soft-handed escort … by taking hold of [Presser’s] right hand in order to lead him out of the stadium,” Torres said in his reporting officer narrative, which can be found in the police report. Presser, however, tensed up and refused to obey Torres.
The suspect then pushed the officer’s hand away from grabbing a hold of him, which led to Torres and other officers taking him to the ground.
Earlier in the evening, Presser had pushed to the floor an Andy Frain Services employee, whose identity cannot be disclosed, after the employee refused to let him enter the stadium.
The suspect was later transported to Miami-Dade County Jail for processing.
Twenty-two year-old University student Gregory Anthony Montes, along with two others, was also involved in a separate, unrelated incident involving battery.
A fight occurred in the center front stage during the concert, in which Officer Angelo Barrios responded. When Barrios arrived, he noticed a juvenile, whose identity cannot be disclosed because he is a minor, and Ramon Lorenzo Fundora, 36, fighting. Barrios later identified the juvenile as Montes’ brother. All three were later taken into custody.
Both parties admitted that “it was a mutual situation, and there was pushing and fighting involved,” Barrios’ narrative stated. They each agreed not to press charges and were then removed from the concert.
Miami-Dade Fire Rescue arrived at the scene, treated and released all persons involved in the incident.
These few altercations with the University Police Department made little impact on the homecoming concert, however, and was still a success.
After the end of the concert, Lupe Fiasco tweeted, “Thank You Miami!!! Had an awesome time…”
