FIU student Abel Alexander Carvajal, infamously known for creating and participating in a recently exposed racist group chat filled with several FIU students, will be suing FIU and President Jeanette Nuñez over his First Amendment rights.

MIAMI, FL- This morning, Abel Alexander Carvajal and his attorney, Anthony Sabatini, filed a lawsuit against charges placed on him by Florida International University regarding violations of the Student Code of Conduct.
The lawsuit is specifically against FIU and President Jeanette Nuñez. According to Carvajal, no other students have filed lawsuits at this time.
“FIU is seeking to discipline me and several other students for conversations in a private, off-campus group chat which constitute protected speech under the First Amendment to the United States Constitution,” said Carvajal in a written message to PantherNOW.
“The actions taken against me constitute a violation of my rights as an American Citizen. Accordingly, I have sought relief from our judicial system to remedy these wrongs.”

Earlier this month, news of a racist group chat created by Carvajal was leaked and spread across national news outlets. FIU responded by investigating the matter and later announced the students involved would receive charges based on violations of FIU’s Student Code of Conduct.
The official statement sent to FIU students from the office of President Nuñez on March 10 said, “The Office of Civil Rights and the Office of Student Conduct and Academic Integrity have reviewed more than 1,200 pages of evidence and initiated charges based on violations of the university’s non-discrimination regulation and the Student Code of Conduct. I want to thank the individuals who have brought forth additional reports and related information, which have helped with the ongoing investigation.”
Carvajal’s attorney, Anthony Sabatini, announced the lawsuit on his public X account and later reposted it on Instagram.

Sabatini is a Republican commissioner for Florida’s District 1. He is also legally representing students from the University of Florida following their suspensions after a Nazi salute post.
